Conference on “Consequences from the declaration of nullity of the General Urban Development Plan 2010 of Marbella by the Spanish Supreme Court”.

The law firm “Villalba-Coloma-Ankersmit” organized the conference held at hotel NH Marbella (Avda. Conde Rudi, Marbella) on 10 December at 5 pm, with the attendance of and the presentation conducted by Mr. Jesús Jordano Fraga, Professor of Administrative Law at the University of Seville, one of the major experts in urban matters in Andalusia.
Two recent judgments passed by the Supreme Court have declared the PGOU 2010 of Marbella null, taking the urbanistic regulations of the municipality back to the year 1986. The expected consequences seriously affect the legal situation of thousands of properties, projects still in progress and works and, also, potential sales purchase operations, among others, related to said properties.
There are questions to be answered, such as: What is the future for the 16,500 properties legalized under the General Plan of 2010? What happens with the licences granted as a consequence of said Plan? What are the consequences for the investments made in Marbella and based on the Plan that has been declared null?
Once the plan has been declared null, where is the confidence of entrepreneurs, investment funds and individuals who have arrived to our municipality and have made investments based on the General Plan of 2010?
Jesús Jordano Fraga is Professor of Administrative Law at the University of Seville, in the Faculties of Law and Economic and Business Studies. His books include: “La reclasificación del suelo no urbanizable”, “La Nulidad de los Actos administrativos y Derechos Fundamentales” and “La protección del Derecho a un Medio Ambiente Adecuado”. He is responsible for the project “Recursos Naturales y Energía” and “Urbanismo y Ordenación del Territorio en tiempos de crisis”.
